Terms of Service
Quick version: BindiTails is for stories, products, account tools, and pet-family features. Please use the site respectfully, keep your account secure, and remember that memorial, care, and profile tools are personal organization features — not medical or legal advice.
1. Acceptance of Terms
By using BindiTails.com, you agree to these Terms, our Privacy Policy, and any additional policies that apply to specific features, products, or promotions.
2. What BindiTails Provides
BindiTails offers family-friendly storytelling, books, printables, shop content, account tools, pet profiles, memorial-style features, care-hub style organization tools, and related support resources. Some features may still be rolling out, in beta, or available only to certain users.
3. Accounts, Pet Profiles, and Care Features
- You are responsible for keeping your login information secure.
- Please provide accurate information and keep your contact details current.
- If you upload or save pet, memorial, or household information, you confirm you have the right to do so.
- We may suspend or remove accounts that violate these Terms or create security concerns.
4. Shop, Affiliate Links, and Digital Items
Prices, availability, bundles, and promotions may change. Some pages may include affiliate links, including Amazon Associates or similar partner programs, which may earn us a commission on qualifying purchases at no extra cost to you.
Digital products, printable items, and special downloads are for personal use unless a different license is clearly provided.
5. User Content
If you submit reviews, messages, memorial text, profile content, photos, or other materials, you keep ownership of your content but give us a limited right to host, display, and use it only as needed to operate the service. Do not upload unlawful, harmful, infringing, or abusive material.
6. Acceptable Use
You agree not to misuse the site, attempt unauthorized access, interfere with security, scrape content at scale, impersonate others, or use BindiTails in violation of law.
7. No Veterinary, Medical, or Legal Advice
Care-hub tips, pet stories, memorial prompts, travel notes, and product recommendations are informational only. They do not replace veterinary, medical, behavioral, legal, or emergency advice.
8. Privacy, Cookies, and Consumer Rights
Your use of BindiTails is also subject to our Privacy Policy. That policy explains our use of Firebase, Google Analytics, Amazon Associates, and Leaflet/OpenStreetMap, along with data retention, deletion, and your GDPR / CCPA / CPRA rights.
9. Intellectual Property
BindiTails branding, stories, artwork, original copy, page design, and related creative materials belong to Joy, Thee & Me LLC unless otherwise stated. Third-party marks and content remain the property of their owners.
10. Disclaimer and Limitation of Liability
BindiTails is provided as is and as available. To the fullest extent allowed by law, Joy, Thee & Me LLC disclaims warranties and is not liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the site, purchases, third-party services, or reliance on informational content. To the extent any liability is not lawfully excluded, our total aggregate liability to you will not exceed the greater of the amount you paid us in the twelve (12) months before the claim or USD $100.
11. Service Availability
BindiTails is offered on an as available basis. While the service is still growing, we target approximately 90% monthly uptime, measured excluding scheduled maintenance, third-party provider outages (such as hosting, shop, or analytics vendors), and events outside our reasonable control. This is a good-faith operational target, not a guaranteed service-level agreement, and no credits or refunds are owed for downtime, slowdowns, or unavailability. We may perform maintenance or updates at any time, with notice where practical.
12. Children's Use
BindiTails includes family-friendly content, but adults remain responsible for purchases, account activity, and any personal information submitted through the service. Parents and guardians should supervise minors using interactive features.
13. Returns, Refunds, and Cancellations
- Physical products: You may request a return within 30 days of delivery if the item is unused and in original condition. Return shipping is your responsibility unless the item arrived damaged or defective. Approved refunds are issued to the original payment method.
- Digital products, printables, and downloads: Because these are delivered electronically and cannot be returned, all sales are final once the item is delivered or the download link is provided, except where a refund is required by law or the file is defective and we cannot provide a working replacement.
- Pre-orders: You may cancel a pre-order for a full refund any time before the item ships or is delivered.
- Third-party / affiliate purchases: Items you buy from another retailer through an affiliate link are governed by that retailer's own return, refund, and warranty policies, not ours.
14. Indemnification
You agree to defend, indemnify, and hold harmless Joy, Thee & Me LLC and its owners, officers, and contractors from any claims, damages, losses, liabilities, and reasonable expenses (including attorneys' fees) arising from your use or misuse of the site, your content, your violation of these Terms or applicable law, or your infringement of any third-party right.
15. Force Majeure
We are not responsible for any failure or delay in performance caused by events beyond our reasonable control, including natural disasters, fire, flood, severe weather, power or internet outages, hosting or third-party service failures, labor disputes, government action, war, terrorism, civil unrest, or public-health emergencies.
16. Dispute Resolution and Arbitration
If a dispute arises, please contact us first so we can try to resolve it informally. If we cannot, you and Joy, Thee & Me LLC agree that any dispute relating to these Terms or the service will be resolved by binding arbitration on an individual basis, and you and we waive any right to participate in a class, collective, or representative action. Two exceptions: either party may bring an individual claim in small claims court, and either party may seek injunctive relief to protect intellectual property or confidential information. The arbitration and any permitted court proceeding will take place in Texas.
17. Governing Law
These Terms are governed by Texas law, without regard to conflict-of-law principles. If you have a dispute or concern, please contact us first so we can try to resolve it informally.
18. Changes to These Terms
We may update these Terms when our offerings or legal obligations change. The updated version becomes effective when posted with a revised effective date.
